These terms exist in English and Spanish. If they differ, the Spanish version prevails, unless the English one is more favourable to you as a consumer.
The essentials, in one minute
WizeLift is a strength-training app that measures bar speed with your phone's sensors. It is not a medical device and does not give medical advice. Lifting weights carries a risk of injury: train sensibly.
You must be at least 14 years old to use WizeLift.
What you post stays yours. You only give us permission to show it to the people you choose in your privacy settings.
Zero tolerance for harassment, hate, violence, sexual content and any illegal content. You can report and block inside the app, and anyone can tell us by email.
The core app is free. WizeLift Premium, once it is on sale, is bought and cancelled in the App Store or Google Play.
You can export your data and delete your account from the app at any time.
If you are a consumer, you keep every right the law gives you. Nothing in these terms reduces them.
1. Who we are and how to reach us
WizeLift is provided by:
Provider: WizeLift (in formation). WizeLift is a project in formation, run by its founder. The company that will provide it has not been incorporated yet. Its name, tax ID (NIF), registered address and registry details will be added here when it is.
In these terms, "WizeLift", "we", "us" and "our" mean that provider. "You" means the person using the app.
Single points of contact (Digital Services Act, Arts. 11 and 12). For authorities of the Member States, the European Commission, the European Board for Digital Services, and for users: support@wizelift.com. A person answers, not an automated system. Languages: Spanish and English.
WizeLift is an app for velocity-based training (VBT: choosing your load from how fast you move the bar). With it you can:
Measure your sets with your phone's motion sensors, attached to the bar (for example with the WizeLift Kit) or to a machine. The app counts reps and calculates velocity, power, range of motion and other metrics.
Log and plan workouts, routines and rep-max (RM) tests, and see your history and progress.
Use estimates: estimated 1RM, velocity zones, load suggestions and a readiness score calculated on your phone.
Connect Apple Health or Health Connect, if you allow it, to read some health readings and save your workouts there.
Use the social features: follow people, view and comment on workouts, like them, add photos, share a workout by link, train with a partner, and compare yourself on leaderboards and "segments" if your settings allow it.
Export your data (JSON and CSV) and delete your account from the app.
Some features may not be available on every device, language or country, or may be in testing. We will tell you inside the app when a feature is in testing.
3. Who can use WizeLift
You must be at least 14 years old. We ask for your date of birth when you sign up, and our server checks it too. If you live in an EU country where the age for consenting to data processing on your own is higher, the rule in section 15 of the Privacy Policy also applies. If we find that an account belongs to someone under that age, we will close it and delete its data.
If you are under 18, you need permission from a parent or guardian to buy WizeLift Premium or anything else that costs money.
You must be able to enter into a contract under the law of your country, and must not have been barred from WizeLift by an earlier decision of ours (for example, an account closed for breaking these terms).
WizeLift is for personal use. If you want to use it in a gym or with clients, write to us: you may need different terms.
We may limit sign-up, for example to people with an invitation, while the app is in an early phase.
4. Your account
Give true information when you sign up and keep it up to date. Your username must not impersonate another person or a brand.
One account is for one person. Do not share your login.
Protect your password. If you think someone has got into your account, change it and write to support@wizelift.com.
You are responsible for what is done from your account, unless it is caused by a failure on our side or by access you could not prevent.
5. Health and safety — please read
WizeLift is not a medical device. It does not diagnose, treat, cure or prevent any disease or injury. It does not give medical, physiotherapy or nutrition advice. What you see in the app is training information, not health advice.
Lifting weights carries a risk of injury, sometimes serious. So:
If you have a medical condition or an injury, are pregnant, or are coming back after a break, talk to a health professional before you start.
Warm up, use proper technique and pick loads you can control.
For RM tests, sets to failure and maximal lifts, train with safety arms or a spotter.
Stop if you feel pain, dizziness, shortness of breath or chest pain, and get medical help if needed.
Fix your phone and its mount securely. Check they cannot come loose during the set. If you use the WizeLift Kit, follow its instructions and warnings.
Do not look at your phone while you are lifting a load.
The numbers are estimates. Velocity, reps, estimated 1RM, zones, load suggestions and the readiness score come from your phone's sensors and from calculation models. They can be wrong: because of where the phone sits, the mount, the exercise or the sensor itself. Use them as a guide, not as absolute truth, and choose your load based on how you feel.
Health readings. If you connect Apple Health or Health Connect, WizeLift uses those readings (for example resting heart rate, heart-rate variability, sleep or weight) only to adapt your training. They are not used to monitor your health or detect medical problems.
6. Your personal data
How we handle your data is explained in the Privacy Policy. Two key points:
Storing health or body data (for example body-fat %, resting heart rate, weight synced from Apple Health or Health Connect) needs your explicit consent, which we ask for separately and which you can withdraw at any time in Settings › Privacy › Health data. You can log your workouts without giving it.
Accepting these terms is not consent to any of that. They are separate things.
7. Social features and visibility
You decide who sees your profile and your workouts in Settings › Privacy: Public, Followers or Only me. Someone can only follow you once you accept their request.
If you set a workout to Public, anyone with the link can see a summary of it, even without a WizeLift account.
Leaderboards, segments and comparisons show your display name and best marks to other people only if your comparison settings allow it ("Allow comparison" is off by default). You can change this at any time.
You can block anyone. They will stop seeing your content, and you theirs.
Training partners. If you log sets for a partner who does not use WizeLift, enter only a nickname or initials, and do it with their knowledge. Do not add other people's health data.
What you share with others can be copied by them (for example with a screenshot). Share with care.
8. Your content
"Your content" is everything you upload or write in WizeLift: workouts, sets, notes, comments, photos, display name, username and profile photo.
It stays yours. We do not take ownership of it.
So that we can provide the service, you give us a free, non-exclusive, limited licence to store it, make technical copies, adapt its format (for example shrink a photo or strip its location metadata) and show it to the people you choose with your settings, in every country where WizeLift is available.
This licence is only for running WizeLift. We will not use it for advertising or sell it to anyone. If we ever want to use your content for something else (for example one of your photos on the WizeLift website), we will ask you separately.
The licence ends when you delete that content or your account. Exceptions: copies other people have already made, and data the law requires us to keep for a while. Technical backups, if any, are overwritten within 7 days at most.
You confirm that you have the right to post what you upload (for example, that the photo is yours or that you have permission from the people in it).
9. Rules of use — zero tolerance
WizeLift has zero tolerance for objectionable content and for users who harass or abuse others. You must not post, send or do:
Anything illegal, or anything that promotes illegal activity.
Harassment, threats, intimidation or insults towards other people.
Hate speech or discrimination based on origin, religion, sex, sexual orientation, disability, age or any other characteristic.
Sexual content or nudity, and never any sexual content involving minors.
Graphic violence, self-harm or encouraging either.
Promoting or selling doping substances, drugs, weapons or other banned products.
Other people's personal data without their permission (addresses, phone numbers, private photos, health data).
Impersonating another person, a brand or WizeLift.
Spam, unsolicited advertising or misleading links.
Content that infringes copyright, trademarks or other people's rights.
Fake training data to manipulate leaderboards or segments.
Trying to access other people's data or accounts, bypass security measures, overload the service, or extract data automatically (scraping, bots).
Using WizeLift to build a competing service, or to train AI models on other users' content.
If you find a security flaw, do not exploit it: tell us at support@wizelift.com. We welcome good-faith reports.
10. Moderation: notices, decisions and how to appeal
This section explains how we moderate content, as required by the EU Digital Services Act (Regulation (EU) 2022/2065, "DSA"), Arts. 14, 16, 17 and 18.
How to tell us.
- In the app: use Report on a profile, workout or comment, or Block to stop seeing someone.
- Without an account, or for illegal content: any person or organisation can write to support@wizelift.com. So we can act, include: (a) why you believe the content is illegal or breaks these terms; (b) the link or exact location of the content; (c) your name and email (not needed for child sexual abuse material); and (d) a statement that you are acting in good faith and that what you say is accurate and complete to the best of your knowledge.
What we do with a notice.
- We confirm we have received it, if you gave us an email address.
- A person reviews it. We aim to review every notice within 24 hours.
- We use an automatic word filter that blocks certain offensive terms in comments, display names and usernames. All other decisions are taken by a person.
- We tell you what we decided and what you can do if you disagree.
Measures we may take, always in proportion to how serious the issue is and whether it is repeated: remove content or limit who can see it, take down a photo, change a username that impersonates someone, limit social features, suspend the account temporarily or, in serious or repeated cases, close it.
If a measure affects you, we tell you why (statement of reasons, DSA Art. 17): which content or account, what measure and how far it goes, the facts, the rule in these terms or the law we relied on, whether any automated means were used, and how you can challenge it. We will only skip this if we have no way to contact you or an authority tells us not to.
How to appeal. If you disagree with a decision (as the person who reported or the person affected), reply to support@wizelift.com within 6 months explaining why. Another person will review the decision, where possible someone other than the person who took it, and we will give you a reasoned answer. You can always go to court as well.
Serious crimes. If we become aware of information suggesting a crime that threatens someone's life or safety, we will report it to the police or judicial authorities (DSA Art. 18).
Misuse of notices. If someone frequently sends notices that are clearly unfounded, we may stop processing their notices for a reasonable period, after warning them.
11. The app and our rights
WizeLift (the software, design, brand, texts and algorithms) belongs to us or to those who licensed it to us.
We give you a personal, non-exclusive, non-transferable licence, free of charge (except Premium), to install and use the app on your devices, for private use and in line with these terms.
You may not copy, modify, distribute, sell or decompile the app, except where the law expressly allows it (for example Art. 100 of the Spanish Intellectual Property Act).
Some components of WizeLift are open-source software and are governed by their own licences. The list of these components and their licences is available on request at support@wizelift.com.
12. Third-party services
Apple Health and Health Connect run under Apple's and Google's terms. You decide on your phone which data you share with WizeLift, and you can withdraw permission at any time.
Strava and other integrations are switched on only if you connect your account on that service (Settings › Connected apps), and are also governed by its terms. You can disconnect them at any time.
Artificial intelligence. If we offer AI features in the future (such as workout summaries), they will be optional; we will tell you which provider runs them and what data is sent, and we will ask for your consent before switching them on. Their output will be labelled as AI-generated and is not medical advice.
We are not responsible for how third-party services we do not control work, without prejudice to what the law says.
13. WizeLift Premium
This section applies once WizeLift Premium is on sale in the app. Today it cannot be bought.
What it includes. WizeLift Premium adds extra features to the free app. Today: long-range trends (6 months, 1 year and full history) and alternative app icons. The up-to-date list is always in Settings › WizeLift Premium before you buy. The features you need to use the WizeLift Kit are not paid (section 14).
Plans and price.
- Monthly and yearly: subscriptions that renew automatically at the end of each period until you cancel.
- Lifetime: a single payment, with no renewals, that gives Premium for as long as WizeLift keeps providing the service (see section 17).
- The final price, including taxes, is the one the App Store or Google Play shows you before you pay, in your currency.
Who charges you. You buy Premium through the App Store (Apple) or Google Play (Google). They handle payment, the invoice or receipt, renewal, cancellation and refunds, under their own terms. We never see or store your card details.
Cancelling. You can cancel at any time, at no cost, from your store's subscription settings:
- iPhone: Settings › [your name] › Subscriptions › WizeLift › Cancel Subscription.
- Android: Google Play › Profile › Payments & subscriptions › Subscriptions › WizeLift › Cancel.
If you cancel, you keep Premium until the end of the period already paid for, and it does not renew. Deleting the app or your WizeLift account does not cancel the subscription in the store: cancel it there.
Notice before renewal. For fixed-term plans that renew (such as the yearly plan), we will remind you at least 15 days before the deadline to cancel the renewal, and tell you what happens if you do not cancel.
Price changes. If we raise a subscription price, we will tell you in advance through the store, and you will not be charged the new price without the notice or consent the store and the law require. If you do not agree, you can cancel before the renewal.
Right of withdrawal (14 days). As a consumer in the EU, you have 14 calendar days from purchase to withdraw without giving a reason.
- How: the quickest way is to ask your store (Apple: reportaproblem.apple.com or your purchase history; Google Play: refund request). You can also write to support@wizelift.com with your account email and the purchase date, and we will help you.
- Subscriptions: Premium is a service that starts as soon as you pay, because you ask for it to start straight away when you buy. If you withdraw within the 14 days, the law allows a deduction for the share of the period you have already used (Art. 108.4 TRLGDCU).
- One-off digital content: you lose the right of withdrawal only if, before buying, you give us your express consent to receive it immediately, you acknowledge that you thereby lose the right of withdrawal, and we send you a confirmation (Art. 103(m) TRLGDCU). If all three do not happen, you keep the right.
- The stores may give you more favourable terms. If so, those apply.
Free or promotional Premium. We may give Premium for free or through a promo code for a limited time. We will tell you when it ends. When it ends you go back to the free version, with no automatic charges unless you buy a subscription yourself.
If something in Premium does not work, you have the rights in section 19.
14. WizeLift Kit and free features
Buying the WizeLift Kit (bar mount and other accessories) is governed by the Terms of Sale, not by this section.
The app features the WizeLift Kit needs to work (measuring sets with the phone fixed to the bar, rep counting, velocity and your workout history) are and will remain free for at least 3 years from the delivery of each Kit. We will not move them into Premium.
15. Availability and changes to the app
We work to keep WizeLift running, but there may be outages for maintenance, updates, faults or causes outside our control. We will try to warn you about planned outages.
We update the app to fix bugs, improve security, comply with the law or add features. Some updates may be needed to keep using WizeLift.
If a change materially worsens your access to, or use of, something you paid for (Premium), we will tell you in advance and in writing (for example by email). You may terminate the contract free of charge within 30 days and get back the pro-rata share of what you paid for the remaining period, unless we let you keep using it without the change (Arts. 126 and 126 bis TRLGDCU).
16. Changes to these terms
We will only change these terms for valid reasons: a change in the law or a decision by an authority, new features, changes in app-store rules, security improvements, or to make the text clearer.
If the change is significant, we will tell you in the app or by email at least 30 days before it applies, unless the law requires us to act sooner. If you do not agree, you can delete your account before that date and, if you have paid Premium, cancel it and get back the pro-rata share of the period you will not use. Earlier versions are available on request at support@wizelift.com.
17. Leaving, suspension and closure
You can leave at any time.
- Export your data in Settings › Your data › Export all my data (and Export every set as CSV).
- Delete only your training data in Settings › Your data › Delete all training data.
- Delete your account in Settings › Account › Account ownership › Delete account, or ask by email from your account's address at support@wizelift.com (see how to delete your account).
- Remember to cancel Premium in your store (section 13).
We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if your account puts other people or the service at risk. Except in serious or urgent cases, we will warn you first and give you a chance to explain. We will always give you our reasons (section 10). If we close your account without you having broken anything, we will give you at least 30 days' notice and refund the pro-rata share of any paid Premium you will not get to use.
If we stop providing WizeLift, we will give you at least 60 days' notice, so you can export your data. We will refund the pro-rata share of subscriptions paid in advance. The Lifetime plan is not on sale; before it is, these terms will say what happens to it if WizeLift closes.
18. Liability
We are responsible for providing WizeLift with due care and in line with these terms and the law.
Nothing in these terms excludes or limits our liability for: death or personal injury caused by our act or omission; wilful misconduct or gross negligence; your statutory rights as a consumer, including the legal guarantee of conformity; or any other liability that the law does not allow us to limit.
Within those limits, we are not liable for:
- Injury or damage caused by not following the safety guidance in section 5, using unsuitable loads or technique, or making training decisions without regard to your health.
- Damage caused by faults in your phone, your connection, third-party mounts or accessories, or third-party services we do not control.
- Content posted by other people, unless, after learning it is illegal, we fail to act diligently to remove it.
- Interruptions or damage caused by force majeure: events we could not foresee or which, if foreseen, were unavoidable.
We recommend exporting your data from time to time.
If you use WizeLift as a business or professional (not as a consumer), to the extent the law allows, our total liability is limited to what you paid us in the 12 months before the event, and we are not liable for lost profits or indirect damage.
19. Legal guarantee
The app (including the free version) and WizeLift Premium are a digital service. If they do not work as described in these terms and in the app, you have the conformity rights the law gives you (Arts. 114 et seq. TRLGDCU): to ask us to fix it and, if we do not, a price reduction or termination of the contract. Write to support@wizelift.com.
20. Terms if you download WizeLift from the App Store or Google Play
App Store (Apple). If you download WizeLift from the App Store:
1. This agreement is between you and us, not Apple. Apple is not responsible for the app or its content.
2. The licence is non-transferable and limited to Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (except as allowed by Family Sharing or volume purchasing).
3. We alone are responsible for maintenance and support of the app. Apple has no obligation whatsoever to provide them.
4. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever. Any other claim for non-conformity is our responsibility.
5. We, not Apple, are responsible for addressing any claims by you or any third party relating to the app, including product-liability claims, failure to meet legal or regulatory requirements, consumer-protection or privacy claims, and claims related to the use of HealthKit.
6. If a third party claims that the app or your use of it infringes their intellectual-property rights, we, not Apple, will be responsible for investigating, defending, settling and discharging that claim.
7. You confirm that you are not located in a country subject to a U.S. Government embargo or designated by it as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
8. Our name, address and contact details for questions, complaints or claims are in section 1.
9. You must comply with any applicable third-party terms when using the app (for example those of your mobile carrier or network).
10. Apple and its subsidiaries are third-party beneficiaries of these terms, and upon your acceptance Apple will have the right to enforce them against you as a third-party beneficiary.
Anything these terms do not cover is governed by Apple's Licensed Application End User License Agreement (Standard EULA). If anything in this section conflicts with the rest of these terms, this section prevails for App Store downloads.
Google Play. If you download WizeLift from Google Play, the Google Play Terms of Service also apply to your purchase and download. Google is not a party to this agreement.
21. Governing law, complaints and courts
Complaints. You can make a complaint by email to support@wizelift.com. When the company is incorporated, we will also add a postal address and a phone number in section 1. We will give you a reference number and reply within 15 days at the latest (Art. 21 TRLGDCU). You may also ask for official complaint forms (hojas de reclamaciones).
Out-of-court resolution. We are not members of any alternative dispute-resolution scheme for consumer disputes. You can contact the Junta Arbitral de Consumo or the consumer office of your region, although arbitration requires our agreement.
Governing law. These terms are governed by Spanish law. If you are a consumer living in another EU country, you also keep the protection of the mandatory rules of your country (Art. 6 of the Rome I Regulation).
Courts. If you are a consumer, you can bring a claim before the courts where you live, and we can only sue you before those courts (Art. 90.2 TRLGDCU, Art. 52.3 of the Spanish Civil Procedure Act and Arts. 17-18 of Regulation (EU) 1215/2012). If you are not a consumer, the courts of Madrid (Spain) have jurisdiction.
22. Other terms
Language. These terms exist in Spanish and English. If they differ, the Spanish version prevails, unless the other is more favourable to you as a consumer. The app is available in more languages, but the terms only in these two.
If a clause is invalid, the rest still applies.
No waiver. Not exercising a right at a given moment does not mean we give it up.
Assignment. We may transfer this agreement to a company that takes over providing WizeLift (for example a company we set up to run it), as long as this does not reduce your guarantees. We will tell you first, and if you do not agree you can leave and, if you have paid Premium, get back the pro-rata share you have not used.
Entire agreement. These terms, the Privacy Policy and, if you buy the Kit, the Terms of Sale make up the agreement between you and us about WizeLift.
Record. We keep a record of which version of these terms you accepted and when. You can download or print them at https://wizelift.com/terms.html.
No compartas tu acceso.
Puedes bloquear a cualquier persona.
Acoso, amenazas, intimidación o insultos a otras personas.
Violencia gráfica, autolesiones o incitación a ellas.
Suplantar a otra persona, marca o a WizeLift.
Spam, publicidad no pedida o enlaces engañosos.
12. Servicios de terceros
Apple Salud y Health Connect.
- iPhone: Ajustes › [tu nombre] › Suscripciones › WizeLift › Cancelar suscripción.
- Android: Google Play › Perfil › Pagos y suscripciones › Suscripciones › WizeLift › Cancelar.
21 TRLGDCU).
6 del Reglamento Roma I).
Tribunales.
